Introduction
Welcome to Gamelytics.io ("Gamelytics," "we," "us," or "our"). These Terms and Conditions ("Terms") govern your access to and use of our website (gamelytics.io), our analytics services (including the API for data collection and the web portal for reporting and analytics), and any related applications, features, or content (collectively, the "Services"). Our Services are designed for indie game developers and small studios to collect, analyze, and report on game-related data.
By accessing or using the Services, you agree to be bound by these Terms. If you are using the Services on behalf of a company or other entity, you represent that you have the authority to bind that entity to these Terms. If you do not agree to these Terms, you must not access or use the Services.
We may update these Terms from time to time. We will notify you of any material changes by posting the updated Terms on this page and updating the "Effective Date" at the top. Your continued use of the Services after the effective date of any changes constitutes your acceptance of the revised Terms.
Eligibility
You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Services. By using the Services, you represent and warrant that you meet this eligibility requirement and that you have not been previously suspended or removed from the Services.
Account Registration and Security
To access certain features of the Services, you must create an account. You agree to provide accurate, current, and complete information during registration and to update such information as necessary. You are responsible for maintaining the confidentiality of your account credentials (including username and password) and for all activities that occur under your account.
You must notify us immediately of any unauthorized use of your account or any other breach of security. We reserve the right to suspend or terminate your account if we suspect unauthorized activity or violation of these Terms.
Description of Services
Gamelytics provides analytics tools for game developers, including:
- An API for collecting game data (e.g., player metrics, session data).
- A web portal for viewing reports, dashboards, and insights derived from the collected data.
The Services are provided on a subscription basis, with different tiers (e.g., free, paid) offering varying features, such as data retention periods and offline backups. We may add, modify, or discontinue features at any time, with or without notice.
User Content and Data
You may submit or upload data, content, or materials through the Services (collectively, "User Content"), including game analytics data via the API. You retain ownership of your User Content, but by submitting it, you grant us a worldwide, non-exclusive, royalty-free, sublicensable license to use, store, process, and display your User Content solely to provide and improve the Services.
You represent and warrant that:
- You have all necessary rights to submit User Content and grant the above license.
- Your User Content does not infringe on any third-party rights, including intellectual property, privacy, or publicity rights.
- Your User Content complies with all applicable laws and does not contain harmful code, viruses, or malware.
We are not responsible for the accuracy, integrity, or quality of User Content. We may, but are not obligated to, monitor, review, or remove User Content that violates these Terms or applicable laws.
As detailed in our Privacy Policy, collected data is ephemeral, used solely for providing analytics services, and deleted after the retention period (which varies by plan). We do not sell or share data, and offline backups are available only on paid tiers.
API Usage
If you integrate our API into your games or applications:
- You must comply with our API documentation and any usage guidelines we provide.
- You agree not to overload, abuse, or misuse the API (e.g., by exceeding rate limits or using it for unauthorized purposes).
- We may monitor API usage and suspend access if we detect violations.
Prohibited Conduct
You agree not to:
- Use the Services for any illegal, fraudulent, or unauthorized purpose.
- Interfere with or disrupt the Services, including by hacking, transmitting viruses, or engaging in denial-of-service attacks.
- Reverse engineer, decompile, or disassemble any part of the Services.
- Collect or harvest data from the Services without our permission.
- Impersonate any person or entity or misrepresent your affiliation.
- Post or transmit spam, unsolicited advertising, or harmful content.
- Violate any third-party rights or applicable laws.
We reserve the right to investigate and take appropriate action against violations, including terminating your account and reporting to authorities.
Intellectual Property
The Services, including all software, code, designs, text, graphics, logos, and other materials (collectively, "Gamelytics Content"), are owned by us or our licensors and protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to access and use the Services for your internal business purposes, subject to these Terms.
You may not copy, modify, distribute, sell, or create derivative works from Gamelytics Content without our prior written consent.
Payments and Subscriptions
Certain features require a paid subscription. Subscription fees are as described on our website and may be subject to change with notice. Payments are processed through third-party providers, and you agree to their terms.
All fees are non-refundable, except as required by law. You are responsible for all taxes associated with your purchases. If your payment method fails, we may suspend your access until payment is received.
Free tiers may have limitations, such as shorter data retention or reduced features.
Termination
You may terminate your account at any time by contacting us. Upon termination, your access to the Services will cease, and any retained data may be deleted in accordance with our Privacy Policy.
We may suspend or terminate your account and access to the Services at any time, with or without notice, for reasons including but not limited to violation of these Terms, non-payment, or inactivity.
Upon termination, all licenses granted to you will end, and you must cease using the Services.
